Intellectual Property Rights at Trade Fairs<\/b><\/p>\n

What good is the best industrial property right if competitors do not respect it?<\/p>\n

Unfortunately, there is an increasing trend of competitors disregarding intellectual property rights or even deliberately infringing them and offering and distributing copies.<\/p>\n

Industrial property rights (including trademarks, designs, patents, or utility models) often arise through registration in public registers. This informs the interested public that the owner has the right to prevent the production and\/or distribution of identical or similar products by competitors.<\/p>\n

Often, one first becomes aware of such copies at a trade fair or exhibition. Then, quick action is necessary to stop the presentation of the infringing products as soon as possible.<\/p>\n

Defense Options<\/h5>\n

We are happy to support you with such rapid measures in the Rhine-Main area and especially also at the Frankfurt am Main trade fair. Often, by handing over warnings<\/b> and personally explaining the accusation, a declaration of cease and desist can be obtained directly at the exhibition stand. The product is then removed from the trade fair stand within a few hours, and distribution in Germany and possibly also in the EU is effectively prevented.<\/p>\n

If the exhibitor refuses to issue a declaration of cease and desist, and explanatory statements do not help further, we can, upon request, obtain preliminary injunctions<\/b> from the competent court and enforce them through the bailiff responsible for the trade fair. This is also often possible within 24 hours. The enforcement can range from removing the infringing object to clearing the exhibition stand – depending on the nature and extent of the infringement.<\/p>\n
